Regulatory Landscape
The rules are being written while the market runs.
An institutional manager in this market operates under rules that are, in several important areas, still being drafted. That is not a reason to wait; it is a reason to build to the standard the rules are converging on and to track each development closely. This page summarizes the areas Wesvel watches most closely as of the date shown, and how they shape its operations.
Custody of client assets
The US securities regulator has moved to modernize the custody rules that govern how registered advisers and funds hold client assets, with digital assets and the technologies used to secure them, including multi-party computation and multi-signature arrangements, explicitly in scope. As of late 2026 the amendments are at the proposal stage. Wesvel’s architecture is built to the direction of travel: independent, regulated custodians where required, segregation, and controls assurance.
Stablecoins
Federal stablecoin legislation enacted in 2025 establishes a framework for payment stablecoin issuers, with implementing regulations issued through 2026 and effectiveness scheduled for early 2027 at the latest. The law prohibits issuers from paying yield for merely holding a payment stablecoin, which draws a legal line between payment stablecoins and yield-bearing instruments such as tokenized money market funds. That line matters for how the stablecoin-yield sleeve is constructed and which instruments qualify as settlement currency.
Derivatives and event contracts
Perpetual futures liquidity remains concentrated on venues outside the United States, with different regulatory and legal-recourse profiles. Event contracts are the subject of active federal rulemaking and state-level litigation over jurisdiction. Venue eligibility is a legal determination made per venue and per fund vehicle, and it can change.
Banking access
State-chartered depository institutions built for digital assets, and national banks now permitted to offer related services, provide the fiat rails the strategies rely on. Access to those rails is a regulatory as well as a commercial relationship, and the book holds relationships with more than one institution.
Practice
How Wesvel approaches it
- 01Operations are built to the standard rules are converging on, not the minimum currently required.
- 02Regulatory developments affecting custody, stablecoins, venues and tokenized instruments are reviewed on a schedule, with counsel, and recorded.
- 03Venue and instrument eligibility are legal determinations made per fund vehicle and refreshed on any development.
- 04Exit and substitution plans exist for every dependency a regulatory change could remove.
